Litinas-aloe.gr is the website which describes the services made available to you subject to the following terms and conditions (the “Terms and Conditions”). By accessing or using the Site, you are acknowledging that you have read, understood and agreed, without limitations or qualifications, to be bound by these Terms and Conditions which incorporate, as an integral part, our Personal Data Privacy Policy, which has been drafted in conformity with Regulation (EU) 2016/679 (General Data Protection Regulation) and the respective national legislation and principles of law. During the access or use of the Site, you must comply with these Terms and Conditions and the special warnings or instructions for access or use posted on the Site. You must always act in accordance with the law, fair trade practices and in good faith. You may not make any change or alteration to the Site or its content or services that appear on this Site and you may not impair in any way the integrity or operation of the Site. If you willfully or negligently breach any of the obligations set out in these Terms and Conditions (including the Personal Data Privacy Policy), you shall be held liable for all loss and damages that this may incur to LITINAS ALOE, its affiliates, partners or licensors. All information available on the Site is intended to be used for educational or informational purposes only. Notices and products are not intended to diagnose, treat, cure or prevent any condition or disease for which in any case, you must consult with your physician. The Site is owned by the Greek company under the name “LITINAS ALOE PRODUCTS A.B.E.E.”, whose registered seat is located at the 42o klm of National Road Athens-Lamia, Avlonas, Attica, P.C. 19011, Greece.

When describing our products on the Site we try to be as accurate as possible; however, to the extent permitted by applicable law, we do not warrant that the product descriptions, colors or other content available on the Site are always accurate, complete, reliable, current or error-free.

The overall content available on the Site, including, but not limited to, text, graphics, logos, button icons, images, audio clips, data compilations and software, and the compilation thereof (the “Content”), is the property of LITINAS ALOE, its affiliates, partners or licensors.

Unless otherwise provided for, all brand names, product and service names used in the Site constitute the trademarks, trade names or service marks of LITINAS ALOE. You may not distribute products or offer services under or by reference to or otherwise use or reproduce any such LITINAS ALOE trademarks, trade names or service marks, or use any meta tags or any other “hidden text” utilizing any such trademarks, trade names or service marks, without the express prior written permission of LITINAS ALOE the owner of such trademarks, trade names or service marks.

Except as set forth in the “limited licenses” in the section below, or as required under applicable law, neither the Content, nor the trademarks, nor any part of the Site may be used, reproduced, copied, sold, resold, accessed, modified or be otherwise exploited, in whole or in part, for any purpose without our prior written consent.

We grant you a limited, freely revocable and non-exclusive license to access and make personal use of the Site. This limited license does not include the right to:
(a) frame or utilize framing techniques to enclose the Site or any part thereof;
(b) modify or download the Site or Content (except caching or as necessary to view the Site);
(c) make any use of the Site or Content other than personal use;
(d) create any derivative work based upon either the Site or Content;
(e) use any meta tags or other “hidden text” utilizing our name or the trademarks or otherwise use the trademarks; or
(f) use software robots, spiders, crawlers or other similar data gathering and extraction tool or take any other action that may impose an unreasonable burden or load on our infrastructure.

(a) may link to, but not replicate, our Content;
(b) does not imply that we are endorsing such website or its services or products;

(g) we may, in our sole discretion, request that you remove any link to the Site and, upon receipt of such request, you shall immediately remove such link.

Any unauthorized use by you of the Site terminates the limited licenses set forth in this section, without prejudice to any other legal right provided for by applicable law or the Terms and Conditions.

All products and services available on the Site are governed by these Terms and Conditions, including the Personal Data Privacy Policy. Any kind of information relevant to any of those products or services, such as product availability and features, and any other relevant information is available on the products page.

If an item is not available, it will be shown as out-of-stock on its product page. Unfortunately you cannot add out-of-stock items to your Shopping Bag. In rare cases, a product may be in stock when you place your order and sold out by the time your order is processed. However, if an item that is available when you place your order is sold out at the time your order is processed, we will notify you by e-mail that your order will not be filled and your credit card will not be charged. All prices indicated for products available on the Site are inclusive of VAT (where applicable) at the current rates and are exclusive of shipping charges. The total cost of your order is the price of products ordered including VAT and shipping charges as set out in the Shipping Policy below.

Reference to any product or service on the Site does not constitute an offer to sell or supply that product or service and does not mean that the description of any product in your local shop will be the same as that LITINAS ALOE included on the Site. We in no way imply that the materials on our Site are appropriate or available for use outside of the EU and we will not be able to fill your order if you require shipping outside of the EU.

If you wish to purchase any products or use certain services on the Site, you must open an account with us. To register and create an account click here and fill in the required fields with your personal information. All of the information you provide will be limited to what is strictly necessary and proportionate and will be held in accordance with our Personal Data Privacy Policy.

By entering any information on the Site, you represent and warrant that: (i) you are at least 18 years of age;
(ii) you are using your actual identity;
(iii) you have provided only true, accurate, current and complete information; and
(iv) you will maintain and promptly update the information that you provide to keep it true, accurate, current and complete at all times.
Additionally, you agree to maintain the strict confidentiality of your account and any passwords issued to you for your use of or access to the Site or any portion thereof, and you agree not to allow any other entity to use any username(s) or password(s) that are issued to you. You shall be responsible for all activity that occurs under your account or password. We cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations. All information provided to us will be used in accordance with our Data Protection Privacy Policy.

If you wish to cancel a username or password, or if you become aware of any loss, theft or unauthorized use of a username or password, please notify us immediately. We reserve the right to delete or change any username or password at any time and for any reason. We also reserve the right to refuse service and/or terminate accounts without prior notice if you violate these Terms and Conditions or if we decide that it would be in LITINAS ALOE’s interest to do so.

As a Registered Member you will receive exclusive benefits only available when you shop online such as: (i) Exclusive Offers reserved just for our registered members;
(ii) Favourites’ List containing all your favourite LITINAS ALOE products, which we shall keep on file for future visits and convenient shopping;
(iii) notification by email on LITINAS ALOE’s news;
(iv) Fast Checkout entailing the storage of your billing and shipping information for future orders; and
(v) Order History which enables you to check your previous orders’ information and status as well as to re-order from previous purchases. In order to view your order history you need to sign into My Account and select Order History from the left hand selection bar.

You may at any point in time unsubscribe from any of the services provided to you or receiving emails from us by editing your profile under My Account or simply by clicking the unsubscribe link at the bottom of an email we have sent you.

Shopping is easy, convenient and secure. Simply select the product you want to purchase, the desired quantity, size or shade and click “add to bag”. When you’ve completed shopping click the “Continue Checkout” button and follow the instructions to checkout and complete your order. Please note that you may change the contents or edit the quantities of items in your shopping bag until you click “Submit Order”, after which your order will be processed. After submitting your order, a “Thank You” page will be displayed and your order number will be provided. You will also receive an email confirmation shortly after your order has been submitted (please check both junkmail and inbox). If your email confirmation does not arrive within 24 hours after you have placed your order, please contact us via email for assistance.

You may track your order by using your tracking number included in your shipping confirmation email or via the Order History section for registered members only.

If you have any questions or concerns when placing an order or if you wish to inquire about a previously placed order, please email us using your order number.

LITINAS ALOE accepts Visa and Mastercard credit cards. Entering credit card information on this is secure. All order information is encrypted (using SSL-256bit encryption technology) in order to protect credit card information submitted during the checkout process. For security purposes, your billing name and address must match the credit card information used for payment.

LITINAS ALOE also accepts payments through PayPal. Please note that you do not need to have or create a PayPal account to complete an order. PayPal accepts all valid debit and credit cards. After placing your order on our website, you will be redirected on PayPal’s secure page to fulfill your payment. At this point, you can either login your PayPal account or pay with your debit or credit card as a PayPal guest.

If your credit card is declined your order cannot be processed and you will see an automatic message on your screen.

You are responsible for any payments due for any products or services ordered through your account. If we do not receive payment from your credit issuer or its agents, you agree to pay all amounts due to us. You shall also be responsible for any costs of collection of overdue payment.

We would like to inform you that should there be a confirmed fraudulent use of your credit card, your charge may be cancelled following a request to the credit card issuing bank or other issuing institution, which shall investigate your complaint or accusation. For this reason you are required to immediately notify the issuing bank or institution after detecting such occurrence in order for the latter to cancel the card and to preclude its use from unauthorized person.

Promotion codes: From time to time, we will reward our customers with special promotional offers via email. These offers are available for a limited time only and expire on the date communicated. To redeem promotion codes, simply enter your promotion code in the text box marked “Promotion Code” on the Billing page during the Checkout process. When a promotion code is accepted, it will be displayed on the Order Review page. Please note however that promotion codes are case sensitive and should be entered exactly as they appear. Only one promotion code may be used per online order.

After-sales-service: We are available for any after-sales service you may require. Please contact us using the information provided below.

The following Return Policy only applies to online purchases made through Litinas-aloe.gr

You may wish to return your order (in part or whole) within 14 days from shipping without needing to provide any justification. In this case you shall be reimbursed in the same way as you paid for your order.

All items should be returned in their original packaging and unused. The boxes should be kept intact, as they are considered part of the product.

Before scheduling a return, please email us at info@litinas-aloe.gr to give you return instructions.

We’re sorry, your original shipping fees and return shipping fees are not refundable.

We do not wish to receive any confidential, secret or proprietary information or other material from you either through the Site and its services or by e-mail or in any other way. To the extent they do not concern personal data about you, any comments, feedback, information or other materials submitted or sent by you to us will be deemed not to be confidential or secret, unless otherwise agreed in writing prior to their submission to us. By submitting or sending comments, feedback, information or other materials to us, you represent and warrant their originality and that no third party has any rights thereupon. All comments, feedback, information or other materials submitted shall be and remain property of and, subject to the personal data legislation, we shall have an unrestricted right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such material and information (in whole or part) worldwide and/or to incorporate it in other works and in any form, media or technology now known or later developed. You also warrant that any “moral rights” in posted information and materials have been waived.

The Site, and any content available on the Site, is provided on an “as-is” basis. To the extent permitted by applicable law, APIVITA disclaims all warranties, express or implied, in relation to the completeness, correctness, timeliness, merchantability, non-violation or suitability of the content thereof for any use, application or purpose. You expressly agree that use of the Site is exclusively at your sole risk and you assume full responsibility for any costs required for the service or repair of any equipment you use in connection with your use of the Site. Neither we nor any of our business partners warrant that the Site will function uninterruptedly and error-free, that defects, if any, will be corrected or that the Site is free from viruses or other harmful components; nor do we or any of our business partners make any representations or warranties about the accuracy, reliability, timeliness, quality, performance or suitability of the Site or any content available on the Site. In the event of any problem with the Site or any content available on the Site, you agree that your sole remedy is to cease using the Site.

All products and services appearing on the Site are subject only to any applicable explicit warranties. To the extent permitted by applicable law, we disclaim all other warranties of any nature, express or implied, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose, with respect to the products and the services posted on the Site. We disclaim any and all liability for product defect or failure, non-compliance with any codes or misapplication.

Unless otherwise provided by applicable mandatory law, the sole remedy for any claim for damages arising out of or related to any product or service listed or purchased on or through the Site shall be limited to a refund of the purchase price paid for such product or service. Under no circumstances shall we or any of our business partners, or any of our or their respective officers, directors, shareholders, employees, agents or representatives, or any other party involved in creating, producing, transmitting or distributing the Site or any product sold through the Site, or any part thereof, be liable for any punitive, exemplary, consequential, incidental, indirect or special damages arising from or in connection with the Site or any content, products or services made available or listed on it, whether under a theory of breach of contract, negligence, strict liability or otherwise, even if such party has been advised of the possibility of such damages.

In any event and unless otherwise provided by applicable mandatory law, our maximum liability for any of the foregoing types of damages shall be limited to the amount that we receive for the transaction that gave rise to the claim.

You agree to defend and indemnify us for any loss, damage or costs, including reasonable attorneys’ fees, resulting from any third party claim, action or demand resulting from your use of the Site. You also agree to indemnify us for any loss, damage or costs, including reasonable attorneys’ fees, resulting from your use of software robots, spiders, crawlers or similar data gathering and extraction tools or any other action you take that imposes an unreasonable burden or load on our infrastructure.

The Terms and Conditions of the Site, of which the Personal Data Privacy Policy is an integral part, as well as any amendment or change thereof, are governed by and construed in accordance with the laws of Greece, (with the exception of its conflict of law provisions) and the application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded.

If you are a consumer and have your habitual residence in the EU, you additionally enjoy the protection afforded to you by mandatory provisions of the law of your country of residence. We both agree to submit to the non-exclusive jurisdiction of the courts of Athens, Greece, which means that you may bring a claim to enforce your consumer protection rights in connection with these Terms and Conditions in Athens, Greece, or in the EU country in which you live.

You acknowledge and agree that the Terms and Conditions, of which the Personal Data Privacy Policy is an integral part, constitute the complete and only agreement between us concerning your use of the Site.

We reserve the right to amend the Terms and Conditions at any time by posting the changes on the Site. Any such amendment shall be effective once it is posted on the Site. Your continued use of the Site entails your agreement to the Terms and Conditions. We may, without prior notice, terminate any of the rights granted by the Terms and Conditions. You shall comply immediately with any such termination or other notice, including, as applicable, by ceasing any use of the Site.
